These Terms and Conditions ("Terms") govern your access to and use of casebook.co.za and all related services, software, tools and content provided by Casebook (collectively, the "Service"). By creating an account, subscribing to, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Our Refund and Cancellation Policy forms part of these Terms and is incorporated by reference.
2.1 You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. If you register on behalf of a company, firm or other organisation, you confirm that you have the authority to bind that entity to these Terms.
2.2 You are responsible for providing accurate, current registration information and for maintaining the confidentiality of your Account credentials. You are responsible for all activity that occurs under your Account, whether or not authorised by you, except to the extent caused by our negligence or breach of these Terms.
2.3 You must notify us promptly at chris@myaipartner.co.za if you become aware of any unauthorised use of your Account.
3.1 Casebook provides an online platform offering AI-assisted legal research, search across South African case law and legislation, and document drafting and related tools, made available on a subscription basis.
3.2 Casebook is a legal research and technology tool. It is not a law firm, does not provide legal advice, and does not create an attorney-client relationship. Content generated or surfaced by the Service — including AI-generated summaries, analyses, citations and drafts — is provided for informational and research purposes only and must be independently verified before being relied upon for any legal, commercial, litigation or professional purpose.
3.3 You remain solely responsible for reviewing, verifying and exercising independent professional judgment over any Content before using or relying on it. Casebook strongly recommends that Content be reviewed by a qualified legal practitioner before being used in any legal proceeding, filing, advice to a client, or other professional context.
4.1 Access to paid features of the Service requires an active Subscription. Subscription fees, billing frequency and available plans are disclosed at the point of purchase.
4.2 By subscribing, you authorise Casebook and its payment service provider, PayFast, to charge your selected payment method at the applicable billing interval until your Subscription is cancelled.
4.3 Billing, refunds, cancellation rights and cooling-off provisions are governed by our Refund and Cancellation Policy, available at casebook.co.za/refund-policy, which forms part of these Terms.

5.2 We reserve the right to suspend or terminate your Account for any material breach of this section, in accordance with Section 9.
6.1 All intellectual property rights in the Service, including its software, design, trademarks, underlying technology and Casebook-authored Content (excluding underlying public legal source material such as reported judgments and legislation, which remain in the public domain or subject to their own applicable rights), belong to Casebook or its licensors.
6.2 Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your own internal professional or business purposes.
6.3 You retain ownership of any documents, queries or original content you input into the Service. By submitting such content, you grant Casebook a licence to process it as reasonably necessary to provide and improve the Service, subject to Section 7 (Privacy and Data Protection).
7.1 We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our Privacy Policy, available at casebook.co.za/privacy-policy, which forms part of these Terms.
7.2 We take reasonable technical and organisational measures to protect user data and Content submitted to the Service. However, no system is completely secure, and we cannot guarantee absolute security.
7.3 Where you submit client-related or confidential information to the Service, you remain responsible for ensuring that such submission complies with your own professional, ethical and confidentiality obligations.
8.1 The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, Casebook disclaims all warranties, express or implied, including any warranty of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.
8.2 Casebook does not warrant that:
8.3 To the maximum extent permitted by applicable law, Casebook's total liability to you arising out of or in connection with these Terms or the Service, whether in contract, delict or otherwise, is limited to the total Subscription fees paid by you in the 12 months preceding the event giving rise to the claim.
8.4 Casebook is not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profit, loss of business, or loss of data, arising from your use of or inability to use the Service.
8.5 Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited under South African law, including under the Consumer Protection Act 68 of 2008, where applicable.
9.1 We may suspend or terminate your Account or access to the Service, with or without notice, if you materially breach these Terms, engage in conduct that we reasonably believe is unlawful or harmful to Casebook, other users, or third parties, or if required to do so by law.
9.2 You may terminate your Account at any time in accordance with Section 4 and our Refund and Cancellation Policy.
9.3 Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 8, 10 and 11) will survive.
You agree to indemnify and hold Casebook, its directors, employees and agents harmless from any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Service, or your violation of any applicable law or third-party right.
11.1 Governing law. These Terms are governed by the laws of the Republic of South Africa.
11.2 Jurisdiction. The parties submit to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from these Terms.
11.3 Changes to these Terms. We may amend these Terms from time to time. Material changes will be communicated to active subscribers by email, account notification, or notice on the website, and will take effect on the date specified in that notice, which will be at least 30 days from the date of notice unless a shorter period is required by law or necessary to address a security or legal issue.
11.4 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
11.5 No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
11.6 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
11.7 Entire agreement. These Terms, together with our Refund and Cancellation Policy and Privacy Policy, constitute the entire agreement between you and Casebook regarding the Service, superseding any prior agreements.
