This Refund and Cancellation Policy forms part of Casebook's Terms of Service and applies to subscription purchases and other paid digital services supplied through casebook.co.za.
Casebook operates on a recurring subscription basis, including monthly or annual subscriptions as selected at signup.
By subscribing, you authorise Casebook and its payment service provider to charge your selected payment method for the applicable subscription fee at the beginning of each billing cycle until the subscription is cancelled.
The applicable subscription price and billing frequency will be disclosed before payment is authorised.
Casebook is an online digital service. Unless otherwise stated, access to a paid subscription is made available immediately after successful payment.
Where you elect to receive immediate access to Casebook, you expressly request and consent to the digital service commencing immediately after payment.
Section 44 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") provides consumers with a seven-day cooling-off right in certain electronic transactions for services. However, section 42(2)(d) of ECTA provides that this cooling-off right does not apply to services that began with the consumer's consent before the end of that seven-day period.
Accordingly, where you expressly consent to immediate activation of your Casebook subscription and Casebook begins supplying the service immediately, the section 44 cooling-off right may not apply.
Where section 44 does apply to a particular transaction, Casebook will honour the consumer's statutory rights, including any right to cancel and receive the refund required by ECTA.
Nothing in this policy excludes or limits any statutory consumer right that cannot lawfully be excluded.
You may cancel your Casebook subscription at any time through any cancellation facility made available in your account or by emailing chris@myaipartner.co.za.
For ordinary month-to-month subscriptions:
Where an annual or other subscription constitutes a fixed-term consumer agreement to which section 14 of the Consumer Protection Act 68 of 2008 ("CPA") applies, the consumer retains the cancellation rights afforded by that section, including the right to cancel on 20 business days' written or other recorded notice, subject to any reasonable cancellation charge lawfully permitted under the CPA. Section 14 does not apply to transactions between juristic persons.
No provision of this policy overrides a consumer's non-excludable rights under applicable law.
Casebook will provide a full or appropriate partial refund where required by applicable law.
Subject to those rights, Casebook will also provide a refund or appropriate adjustment in the following circumstances:
Under section 54 of the CPA, where applicable, a consumer may have the right to require defective service performance to be remedied or to receive a reasonable refund having regard to the extent of the failure.
Except where applicable law requires otherwise, Casebook does not ordinarily provide refunds merely because:
Nothing in this section removes any right or remedy available to you under applicable law.
Casebook is a legal research and technology service. It does not guarantee that any particular search, AI-generated response, research result, citation, draft or other output will produce a particular legal, commercial, litigation or professional outcome.
Dissatisfaction with the substance of a particular output does not, by itself, entitle a user to a refund where the Casebook service has been supplied and has functioned substantially as described.
This provision does not limit any rights arising from a material failure by Casebook to provide the service purchased or any other rights that cannot lawfully be excluded.

Please provide, where available: your name; the email address associated with your Casebook account; the relevant transaction or payment reference; the date and amount of the payment; and a brief explanation of your request.
We aim to acknowledge refund requests within 3 business days and to resolve them as soon as reasonably practicable.
Where legislation prescribes a particular refund period, the statutory period will apply.
Approved refunds will ordinarily be processed through PayFast and the original payment channel where technically available and appropriate.
Refunds will never exceed the amount originally paid for the relevant transaction.
The time taken for an approved refund to appear may depend on the payment method, PayFast and the customer's bank or financial institution.
PayFast supports merchant refunds, including full and partial refunds for supported payment methods, subject to its applicable processing rules.
If a recurring payment fails, Casebook may notify you and may attempt to process the payment again where permitted.
Continued payment failure may result in suspension or termination of paid access until the account is brought up to date.
If you believe a charge is incorrect, you are encouraged to contact Casebook promptly so that we can investigate and, where appropriate, correct or refund the transaction.
Nothing in this provision prevents you from exercising any lawful right to dispute an unauthorised or incorrect transaction through your bank, card issuer, PayFast or another competent authority.
Casebook may amend this policy from time to time.
Material changes affecting active subscribers will be communicated by reasonable means, which may include email, an account notification or notice on the Casebook website.
Changes will operate prospectively and will not remove rights that have already accrued or any rights provided by applicable law.
